It is NOT affiliated with, endorsed by, sponsored by, or related in any way to the official Studio Ghibli animation studio or its affiliates. All trademarks and copyrights associated with the official Studio Ghibli belong to their respective owners.

The following terminology applies to these Terms and Conditions, Privacy Policy and Refund Policy: "Client", "You" and "Your" refers to you, the person accessing this website and using the Service, compliant to the Company's terms. "The Company", "Ourselves", "We", "Our" and "Us", refers to the operators of Studio Ghibli. "Party", "Parties", or "Us", refers to both the Client and ourselves.

Studio Ghibli provides a service that allows users to upload their personal photographs ("User Content") and use our proprietary AI model to generate new images inspired by the Ghibli art style ("Generated Images"). The Service operates on a credit-based system, with a free trial credit provided and additional credits available for purchase.

2. User Accounts and Credits

You may need to register an account (e.g., via Google Sign-In) to access the full features of the Service.
You are responsible for maintaining the confidentiality of your account information.
Use of the Service requires credits. A free trial credit is provided once per user. Additional credits must be purchased.
Purchased credits are subject to our Return & Refund Policy and have specific validity periods.
During high demand, processing priority may be given to users with purchased credits over free trial users.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

In any way that violates any applicable national or international law or regulation.
To generate images that are defamatory, obscene, pornographic, abusive, harassing, threatening, infringing on intellectual property rights, invasive of privacy, or otherwise objectionable or illegal.
To upload User Content that you do not have the necessary rights, licenses, or permissions to use for this purpose.
To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.
To reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the AI model or the Service.

4. Intellectual Property Rights

a. Our Service and Website:

Unless otherwise stated, We and/or our licensors own the intellectual property rights for all material on the Studio Ghibli Website and the underlying AI technology and models used by the Service. All intellectual property rights are reserved. You may access the Website and use the Service for your personal, non-commercial use subject to restrictions set in these terms.

You must not:

Republish material from the Studio Ghibli Website (e.g., blog posts, descriptions) without attribution and permission where required.
Sell, rent or sub-license material from the Studio Ghibli Website.

b. User Content:

You retain all ownership rights to the original photographs (User Content) you upload to the Service. By uploading User Content, you grant Us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify (solely for the purpose of generating the AI image), and process your User Content strictly for the purpose of providing the Service to you. We will not use your original User Content for any other purpose without your explicit consent. Uploaded User Content is typically deleted from our active servers shortly after processing, as further detailed in our Privacy Policy.

c. Generated Images:

Subject to your compliance with these Terms, We grant you a worldwide, non-exclusive, royalty-free license to use the Generated Images created from your User Content for your personal, non-commercial purposes. You may share these Generated Images online (e.g., social media) provided you do not imply endorsement by or affiliation with Us or the official Studio Ghibli.

Commercial Use: Commercial use (e.g., selling prints, using in marketing materials, NFTs) of Generated Images is strictly prohibited under the standard license. If you are interested in commercial licensing options (if available), please contact us at [email protected].

You acknowledge that due to the nature of AI, Generated Images may not be unique and other users might generate similar images using the Service.

5. User Representations and Warranties

You warrant and represent that:

You own or have the necessary licenses, rights, consents, and permissions to upload and use your User Content in connection with the Service.
Your User Content does not infringe upon any third party's intellectual property rights (copyright, trademark, patent), privacy rights, or publicity rights.
Your User Content does not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material.

You agree to indemnify and hold harmless Studio Ghibli and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your breach of these warranties or your use of the Service in violation of these Terms.

6. Cookies

We employ the use of cookies. By accessing Studio Ghibli, you agreed to use cookies in agreement with our Privacy Policy. Cookies are used by our website to enable functionality and ease of use.

The results (Generated Images) obtained from the use of the Service will be accurate, reliable, or meet your expectations. The quality of Generated Images depends on the input User Content and the inherent nature of AI.

Nothing in this disclaimer will:

limit or exclude our or your liability for death or personal injury resulting from negligence;
limit or exclude our or your liability for fraud or fraudulent misrepresentation;
limit any of our or your liabilities in any way that is not permitted under applicable law; or
exclude any of our or your liabilities that may not be excluded under applicable law.

Subject to the foregoing, our total liability to you for any cause of action arising out of or related to these Terms or the Service will be limited to the amount you paid, if any, to us for the Service in the 12 months preceding the claim.

We will not be liable for any loss or damage of any nature arising from the use of the free trial or if no payment has been made for the Service.

13. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately, and any unused credits may be forfeited as per our Return & Refund Policy.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
